Frequently Asked Questions
What is Title Insurance?
A Title is the legal right that a person has to the ownership and possession of land. It is possible that someone other than the owner has a prior legal claim to the property. If that prior claim can be established, that person may claim an interest in the property outright or make demands on the owner as to its use. Possible reasons for a title to be defective include:
Errors in tax records
Mistakes in recording legal documents
Incorrect representation of marital status
Deeds executed under false or expired powers
Federal, state inheritance and gift tax liens
Easements by prescription not discovered

what can I expect from the
Traditionally, the seller in a transaction chooses the Title Company to use. The selection will be noted in the purchase contract. Once Hayes Title Agency has been selected as the Title company of choice, we will be notified by the real estate agents and/or lending institution. Once we have received a copy of the purchase contract, the wheels start to turn on our end. If there are real estate agents involved, we will communicate directly with them to keep you in the loop as to where the process stands and what additional information may be required from you.
When can we close on
If there is no lender involved in the sale, closing is possible as soon as it is determined that all matters involving the title on the piece of property are resolved. If there is a lender involved with the transaction, the lender will determine the closing date once they have approved all financing. At Hayes Title, we pride ourselves in making the closing itself as convenient and comfortable for all parties as possible.
